Terms of use
Draft status: These terms reflect the currently confirmed platform model. The precise legal classification of the joint operation, consumer dispute resolution, legal requirements for moderation procedures, liability and arrangements for future paid services still require legal or business review before publication.
1. Scope
These terms apply to the Luciago website, app, community, organizer, creator and admin features. Additional terms of an external service or organizer may apply where a user deliberately opens that service or uses an organizer’s offer.
2. Current platform model
Luciago provides technical features for discovering, saving and sharing events, indicating attendance, connecting with people and using community functions. Approved organizers can manage profiles and events. Luciago is currently free for regular users. Verification, organizer profiles, event creation and the organizer features currently offered are also free.
Under the currently confirmed model, Luciago does not sell tickets, process payments or form an event contract between a user and an organizer through the platform. Ticket sales and other paid features are only planned for the future. References to tickets, prices, admission, external shops or offers are information or links to third parties. These terms must be updated before that model changes.
3. Registration and user accounts
Regular use of Luciago is intended for people aged 16 or over. Some features are available without a registered account; community, creator and administration features require sign-in. Users must provide accurate registration details, protect their credentials and notify Luciago of identifiable account misuse. Accounts must not be used to misrepresent identity, role or authority.
A free usage agreement between the user and Luciago is formed when registration is completed and the user expressly accepts these terms. The privacy policy must be acknowledged during registration. The consent box is not preselected.
4. Organizers
Organizer features are intended for authorised people who may represent the relevant organizer. Organizers must keep their information current and ensure team members receive only the permissions they require. A sole owner of an organizer profile must transfer ownership before deleting the personal account.
5. Verification
Luciago may review an organizer’s details and authority and mark a profile as verified. Verification confirms only the account and organizer relationship that was checked. It is not a guarantee of an individual event, its quality, safety, official approval, admission or operation. Luciago may request further evidence or suspend or remove verification where there are reasonable doubts.
TODO: Approve the internal verification criteria, evidence, review periods and appeal route.
6. Events and published information
Anyone posting events or organizer information is responsible for ensuring it is accurate, current, not misleading and lawful. This applies in particular to time, location, price, age or admission information, images, offers and contact details. Changes and cancellations must be updated promptly.
Luciago is not the organizer of a listed event unless the individual event expressly states otherwise.
7. User interactions
Friend, chat, matching, attendance, rating and location features must be used respectfully and for their intended purpose. Live location may be shared only deliberately. Users should share location and contact information only with people they trust. Contact through Luciago is not a guarantee of another user’s identity, intentions or conduct.
8. Prohibited use and content
The following are prohibited in particular:
- unlawful, insulting, discriminatory, threatening, glorifying-violence or sexually exploitative content;
- harassment, stalking, impersonation, fraud, spam or unauthorised advertising;
- publishing another person’s personal data or images without the required authority;
- content infringing copyright, trade marks, personality rights or other third-party rights;
- manipulating ratings, attendance figures, analytics, verification or access rights;
- circumventing safeguards, automated overloading, malware or abusive API use;
- events or offers whose operation or promotion is unlawful.
9. Reports, moderation and measures
Luciago may review reports and, depending on the nature, severity, frequency and impact, remove content, issue a warning, temporarily suspend an account or permanently suspend an account. These measures are not a mandatory escalation sequence. Luciago may skip individual stages and take stronger action immediately in serious, clearly unlawful or safety-related cases. Luciago may also restrict features or suspend or revoke verification.
Affected users may request a review of a moderation or suspension decision by emailing support@luciago.com. TODO: Approve binding community standards, any legally required statements of reasons, procedural time limits and the legally permissible retention of moderation records.
10. Rights in content and image processing
Users and organizers retain their rights in their own content. They may upload, publish or share only content for which they hold the required rights and permissions.
Users and organizers grant Luciago the permission necessary to store, technically reproduce, adapt, publicly display and deliver uploaded content to operate and present the platform. Uploaded images may also be processed or edited with AI to create improved or adapted Luciago and event images. This does not include training Luciago’s own AI models with user images, selling the images or using them arbitrarily for unrelated purposes.
No external AI provider is named while none has been selected for production. Before an external AI service is used in production, its actual data processing and privacy terms must be assessed separately. TODO: Obtain legal review of the duration, territory, sublicensing and termination of the required permission.
11. External services and offers
Links to maps, social media, WhatsApp, email, Cal.com and potential ticket or organizer pages lead to third-party services. The relevant provider is responsible for its content, availability, privacy and contract terms. Users should review the destination provider’s terms.
12. Availability and platform changes
Luciago aims to operate securely and reliably but cannot technically promise uninterrupted or error-free availability. Features may be changed, temporarily restricted or discontinued for security, maintenance, legal or product reasons. Existing published events and legitimate user interests should be considered where reasonably possible.
13. Liability
Mandatory statutory liability rules apply. This draft does not add any further limitation of liability. Organizers and other third parties are responsible for their events, information, services, admission decisions and offers. Users should confirm safety-relevant details and short-notice changes with the relevant organizer.
TODO: Obtain legal review of a liability clause suited to the final business model and operator form.
14. Account deletion and termination
Regular users may delete their account at any time without a notice period through the app or public deletion page. Future events they created personally should also be deleted. Events belonging to an organizer profile with several members or owners are not deleted solely because one member deletes their personal account. Deletion may require the prior transfer of sole organizer ownership.
The former user will no longer appear publicly under their previous profile. Where permissible content remains, “Deleted User” is displayed instead of the username, profile image or other public profile details that are no longer required. Ordinary chat messages or other content are not deleted wholesale solely for this reason. The legally permissible retention of chat and moderation records still requires legal review. Luciago may suspend or end accounts in accordance with these terms and mandatory law.
Technical note: Deleting personally created future events is not yet part of the current account-deletion flow.
15. Changes to these terms
Users will be informed of material changes to these terms in an appropriate form before they take effect. Where the nature or scope of a change requires renewed express acceptance, Luciago will obtain that acceptance. This draft does not set a fixed notice period.
Technical note: The app does not yet store a terms version or acceptance timestamp and cannot currently require renewed acceptance of an updated version.
16. Governing law and dispute resolution
German law generally applies to the usage agreement to the extent permitted by law and without prejudice to mandatory consumer-protection rules. No special jurisdiction clause is imposed on consumers. TODO: Obtain legal review of whether Luciago is willing or required to participate in consumer dispute resolution.
17. Contact
Questions about these terms can be sent to support@luciago.com or through the contact page.
